Who requires a visa?
All foreigners working in Malaysia are required to
apply for a visa.
Validity period: Under normal circumstances,
the visa will expire seven days before the expiry of
the Work Permit.
Waiver of visa application: Foreigners
resident in the Commonwealth countries are exempted
from visa application.
Types of permit
Employment Pass (EP)
Application for an EP must be submitted to the Immigration
Office once approval has been given by the Expatriate
Position Committee. Salary must be more than or equal
to RM2,500.00 and the post approved for a period of
two years or more. The applicant's salary has to be
under the local payroll.
Visit Pass (temporary employment)
Salary must be more than or equal to RM2, 500.00 and
period granted for less than two years. The applicant's
salary has to be under the local payroll.
Visit Pass (professional)
For foreigners assisting in the installation, maintenance,
training, or demonstration of the use of machine/computer
or any new equipment. The duration of the stay must
be for less than six months. The applicant's salary
has to be under the foreign payroll.
Timing / application procedures
Processing time
Four to six weeks.
Timing of application
The applicant is advised to enter Malaysia only upon
approval of the Work Permit application.
Validity period
Subject to the validity of the relevant authorities.
Note: the Immigration Department of Malaysia (IDM)
has delegated the authorities to process the application
of Work Permits according to the company's principal
activities.
Limitation to the number of Work Permits issued to
each company
None. The numbers of expatriate posts are approved
based on the justification in the application.
Fee
An endorsement fee is payable to the Immigration Department
as follows:
Key post – RM300.00 per annum/per post.
Top and middle management/professional and technical – RM200.00
per annum/per post.
Processing fee – RM50.00 per application.
Medical Examination
Not required.
Security Deposit Required
None.
Note
For citizens from certain countries (e.g. India, China
etc) the processing time may be longer as there are
additional procedures to comply with (that is, the
applicant is required to remain outside Malaysia while
the application is being process and only permitted
to enter Malaysia on a Single Entry Visa - visa with
reference - upon approval of his application).
Obligation of local employer
A local sponsor is required and this is normally the
company's resident director/employee or a Malaysian
citizen.
Documents required for work permit application
Copy of passport.
Three photographs.
Academic certificate/School Leaving Certificate (English).
Testimonial/recommendation letter or curriculum vitae
from head office overseas (English).
Expatriate's service/employment contract (original)
with Malaysian company.
Note
It is advisable that all English translations are
certified by the home country Embassy.
Dependant application
The Dependant Pass could be applied for together with
the application for endorsement of Employment Pass.
Should the family members come in a later date, a separate
application for Dependant Pass can be submitted to
Immigration.
Spouse work rights?
Spouse with a dependant pass cannot work in Malaysia.
However, if the spouse wishes to work in Malaysia,
then the dependent pass has to be cancelled and an
application made for the relevant work permit.
Documents required for dependant pass application
Copy of passport.
Three photographs.
Marriage certificate (English), certified copy by relevant
Embassy.
Birth certificate for children (English), certified
copy by relevant Embassy.
